PURCHASE NECESSARY. The
Game materials described below are available in the U.S., Guam,
Saipan, Bahamas, Curacao, Aruba, St. Maarten, St. Thomas,
Suriname and Trinidad (the "Territory"), and
only legal residents of the Territory are eligible to
participate. The Game begins on or about July 11, 2001 in the
Territory and is scheduled to end August 9, 2001 (see Rule 8 for
Game Schedule details).
The 2001
Pick Your Prize Monopoly® Game at McDonald's (the "Game")
provides participants a chance to win prizes instantly and by
collecting designated official Game Stamps (defined below). The
Game is played as set forth below and is subject to these
Official Rules. Verified winners must pick from one (1) of the
three (3) specified prizes in the prize category in which they
have won, for all prizes except the $5, $10 and $20 in-store
cash prizes (hereafter "Cash on the Spot"), $5
in McDonald's Gift Certificates prizes ("Gift
Certificates") and certain McDonald's Food prizes (See
Rule 4 for details).
1. HOW TO
OBTAIN GAME MATERIALS
Obtain a game
board ("Game Board") for the Game, while
supplies last, at any participating McDonald's restaurant in the
Territory upon request, and online at www.mcdonalds.com.
There are three
ways to obtain an official "Game Piece" (an
official Game Piece consists of two official "Game
Stamps") in the Game, while supplies last:
(a) at
participating McDonald's restaurants, one (1) Game Piece is
attached to the following packaging items: Medium and Large Soft
Drink Cups (32 oz. and 42 oz. depending on market), Medium,
Large and Super Size® Fry Boxes (5 oz., 6 oz. and 7 oz.
depending on market), Regular and Large McFlurry™ Dessert Cups
and Hash Browns Bags (distribution of Game Pieces on packaging
items may vary depending upon market); and
(b) one (1) Game
Piece and a Game Board are available in select magazines (Time,
People, Sports Illustrated, Entertainment Weekly, Sports
Illustrated For Kids, People en Espanol, Newsweek, Rolling
Stone, ESPN Magazine, Premiere, Teen, VISTA and Parade) in
the U.S. and in direct mail inserts to be distributed to select
households in the U.S. on or about July 9, 2001 (the "Inserts");
and
(c) three (3)
Game Pieces may be obtained without a McDonald's purchase, while
supplies last, by mailing, postage pre-paid, a hand-printed
self-addressed, stamped envelope (SASE) to: 2001 MONOPOLY Game
at McDonald's, Game Piece Request, P. O. Box 466002,
Lawrenceville, GA, 30042-6002. Vermont residents only may omit
return postage. You may submit as many requests (SASEs) as you
wish, but only one request (SASE) for three Game Pieces per
outer mailing envelope, mailed separately. The three Game Pieces
will include Game Piece(s) from each of the following: (i) two
from the total number of Game Pieces earmarked for distribution
at participating McDonald's restaurants; and (ii) one from the
total number of Game Pieces earmarked for distribution in
Inserts. Requests must be postmarked no later than August 9,
2001 and received no later than August 16, 2001. DO NOT SEND
POTENTIAL WINNING GAME STAMPS OR ANY OTHER GAME STAMPS, GAME
MATERIALS, COMMENTS OR QUESTIONS TO THIS ADDRESS.
2. HOW TO
PLAY AND WIN
There are two
different ways to play and be eligible to win in the Game:
(A) COLLECT TO
WIN - collect the entire series of different official
COLLECT TO WIN Game Stamps ("Collection Stamps")
that constitute a complete collection prize section of the Game
Board as described below; and
(B) INSTANT
WIN - obtain a single official INSTANT WIN Game Stamp
("Instant Win Stamp") as described below.
NOTE: You are
not a winner of any prize until your Game Stamp(s) has been
verified at the Redemption Center or at a participating
McDonald's, whichever is applicable in accordance with these
Official Rules.
To reveal the
face of your Game Stamps, carefully peel off the Game Stamps
from the Game food or drink packaging indicated by the
"pull" tab. In the case of Game Stamps not affixed to
food or drink packaging, detach them from the backing. Follow
the instructions in Part A below if you reveal a Collection
Stamp and Part B below if you reveal an Instant Win Stamp.
All prizes are
detailed in Rule 4 below with the odds of winning and the
approximate retail values (ARVs) set forth in Rule 12 below. All
potential winning Game Stamps must be redeemed in accordance
with Rule 3 below and verified in accordance with Rule 7 below.
A. COLLECT TO
WIN INSTRUCTIONS
Each Collection
Stamp can be identified by instructions on the bottom of the
Game Stamp detailing which Game Stamps a participant must
collect in order to have a complete collection prize section of
the Game Board.
Peel Collection
Stamps off the adhesive backing, and match the name and number
on the Collection Stamp with the corresponding name and number
shown on the Game Board. Stick the Collection Stamp to the
proper place in the collection prize section of the Game Board.
When you have properly collected all of the Collection
Stamps required to complete one collection prize section of the
Game Board, you are a potential winner of the prize indicated on
the applicable Collection Stamps. You must follow the redemption
instructions in Rule 3 below and comply with these Official
Rules in order to redeem the prize.
B. INSTANT WIN
INSTRUCTIONS
Each Instant Win
Stamp can be identified by the words "INSTANT WIN"
which appear in the middle of the face of the Game Stamp. NOTE:
DO NOT AFFIX INSTANT WIN STAMPS TO THE GAME BOARD.
If you have
properly obtained an Instant Win Stamp, you are a potential
winner of the prize indicated and you must follow the redemption
instructions in Rule 3 below and comply with these Official
Rules in order to redeem the prize.
3. HOW TO
REDEEM
A. TO REDEEM
HIGH AND MID-LEVEL COLLECT TO WIN PRIZES

COLLECTION WINNERS MUST VERIFY AND REDEEM AS FOLLOWS:
Cut out the completed collection prize section from your Game
Board and sign your initials in ink across the face of each
Collection Stamp where the property and prize name appear. Then,
request from the manager of any participating McDonald's
restaurant an official pre-addressed Game Redemption Envelope
(request the purple envelope for High-Level prizes and
the orange envelope for Mid-Level prizes). Obtain the
McDonald's restaurant manager's signature on the envelope.
Legibly print or type all of the information requested on
the envelope. Insert your completed collection prize section,
cut from the Game Board (be sure you have initialed each Game
Stamp), in the envelope and send it with correct postage for
official verification by the Redemption Center and award of your
prize. REGISTERED OR EXPRESS MAIL IS STRONGLY RECOMMENDED.
POTENTIAL HIGH AND MID-LEVEL PRIZE WINNERS ARE ENCOURAGED TO
SEND THEIR REDEMPTION ENVELOPE FOR OVERNIGHT DELIVERY RETAINING
A RECEIPT OF MAILING. Only use the official pre-addressed Game
Redemption Envelope available at participating McDonald's
restaurants for verification and redemption of a potential High
and Mid-Level Collect to Win prize claims. THESE ENVELOPES

Instant Win Game Stamp directs you to call a toll free number,
do so immediately for instructions.
You will then receive a package from the Redemption Center with
all pertinent redemption materials. Legibly print or type all
of the information requested on the redemption materials that
you receive. Sign your initials in ink across the face of your
Instant Win Stamp where the prize name and the words
"INSTANT WIN" appear. Insert your Instant Win Stamp
(be sure you have initialed it) with the completed redemption
materials into the provided envelope and mail the envelope to
the Redemption Center for official verification and award of
your prize. If your Instant Win Stamp does not include a toll
free number, then request from the manager of any participating
McDonald's restaurant an official pre-addressed orange Game
Redemption Envelope. Obtain the McDonald's restaurant manager's
signature on the envelope. Legibly print or type all
of the information requested on the envelope. Insert your
Instant Win Stamp and send the envelope with correct postage for
official verification by the Redemption Center and award of your

Remove the
completed collection prize section from your Game Board by
cutting along the dotted lines shown and sign your initials in
ink across the face of each Collection Stamp where the property
name and cash prize appear. Present this collection prize
section to a participating McDonald's restaurant MANAGER
in the Territory. A $20 cash prize may be redeemed upon
verification of the Collection Stamps at the McDonald's
restaurant. All Baltic and Mediterranean collection prize
sections for $20 cash prizes must be redeemed at a participating
McDonald's restaurant. In the event that a $20 cash prize is
won by a minor, he/she must be accompanied by a parent or legal
guardian in order to redeem. DO NOT SEND BALTIC OR
MEDITERRANEAN COLLECTION STAMPS TO THE REDEMPTION CENTER.
D. TO REDEEM
INSTANT WIN McDONALD'S FOOD, McDONALD'S $5 GIFT CERTIFICATE AND
CASH ON THE SPOT PRIZES
McDonald's Food
prizes may be redeemed only during the hours the food product is
served and only on a future visit, except where prohibited by
law. McDonald's Food prizes are not valid in combination with
any other offer or discount. McDonald's Food prizes may be
redeemed upon presentation and verification of your McDonald's
Food Instant Win Stamp at a participating McDonald's restaurant
in the Territory. Game Stamps for Gift Certificate and Cash on
the Spot prizes must be presented for verification and
redemption to the restaurant MANAGER at a participating
McDonald's restaurant in the Territory. In the event that a
cash prize is won by a minor, he/she must be accompanied by a
parent or legal guardian in order to redeem. Only one
McDonald's Food prize redemption per eligible person per visit.
All visits to the same restaurant within a two-hour period
constitute a single visit. Your Instant Win Stamp for a
McDonald's Food prize must be presented for redemption before
placing your order. Participating McDonald's restaurants reserve
the right to substitute a food product of equivalent or greater
retail value for food prizes.
E. REDEMPTION
DEADLINES

TO WIN PRIZES MUST BE REDEEMED AT A PARTICIPATING McDONALD'S
RESTAURANT ON OR BEFORE AUGUST 24, 2001 OR 15 DAYS AFTER THE
GAME OFFICIALLY ENDS (SEE RULE 8 BELOW FOR GAME SCHEDULE),
WHICHEVER IS LATER. ALL CALLS TO THE TOLL FREE NUMBER FOR
HIGH-LEVEL INSTANT WIN PRIZES MUST BE RECEIVED ON OR BEFORE
SEPTEMBER 24, 2001.
ALL GAME
STAMPS AND OTHER GAME MATERIALS FOR HIGH AND MID-LEVEL PRIZE
CLAIMS MUST BE RECEIVED FOR VERIFICATION AND REDEMPTION BY THE
REDEMPTION CENTER ON OR BEFORE OCTOBER 8, 2001. POTENTIAL
WINNERS WILL BE REQUIRED TO EXECUTE AN AFFIDAVIT OF
ELIGIBILITY/LIABILITY RELEASE AND, WHERE LEGAL, A PUBLICITY
RELEASE, WHICH MUST BE COMPLETED AND RETURNED WITHIN A SPECIFIED
TIME AFTER NOTIFICATION OR PRIZE MAY BE FORFEITED.
All Game Stamps
and other Game materials received after the above deadlines are
void and will be ineligible for prizes. Game Stamps and other
Game materials submitted to the Redemption Center will be
verified within 8 weeks from the date of receipt of the Game
materials, or as soon thereafter as is reasonably possible.
Verified High and Mid-Level prize winners will be notified by
mail.
Note: You may win
more than one prize, but you are not a winner of any prize until
your Game Stamp(s), other Game materials, and your compliance
with these Official Rules, have been verified at either the
Redemption Center or at a participating McDonald's restaurant,
whichever is applicable in accordance with these Official Rules.
4. PRIZE

Verified winners

prize category in which they have won, for all prizes except the
Cash on the Spot, Gift Certificates and certain McDonald's Food

purchase and the transfer of title to the winner. Successive 19

Shipping and handling costs and applicable sales tax will be
included as part of the total order/home repair amount, as
applicable, and will be deducted from the $10,000 credit amount.
Each prize must be utilized in full by August 30, 2002.
Other restrictions apply and will be provided to winner upon
award of prize. Winner(s) residing in a country in the Territory
outside the U.S. who are unable to receive services from a
designated OurHouse, Inc. home repair service provider or
contractor, or who are unable to access www.ebay.com or
www.ourhouse.com and/or receive delivery of items purchased on
such websites, as applicable, will be provided with a cash
alternative of US $10,000 in lieu of the prize, at the sole
discretion of the Sponsor (ARV: $10,000).
Entertainment
Event (11 Instant Win, 11
Collection) Winners will receive tickets for four (4) to attend
their choice of one (1) of the following events: (i) the 2002
American Music Awards™; (ii) the 2002 ESPY™ Awards; or (iii)
the 2002 ABC Super Soap Weekend™. Winners choosing to attend
the American Music Awards will receive an opportunity to meet
music celebrities, "BBMAK", subject to touring
schedule, illness or absence from the event for any reason. All
three prize choices also include round-trip coach class air
travel (if necessary), between a major commercial airport in the
U.S. near the winner's home as designated by the Sponsor and the
designated airport near the selected event as designated by the
Sponsor, 2 nights standard hotel accommodations, two rooms
double occupancy, and ground transportation between the
destination airport and hotel, as well as between the hotel and
event. If a winner resides less than 200 miles from the event,
ground transportation will be provided in lieu of air
transportation. Winners who reside outside the U.S. will be
provided a check in the amount of US $8,000 in lieu of the
prize, at the sole discretion of the Sponsor (ARV: $8,000).
All-Inclusive
Vacation (25 Instant Win,
25 Collection) Winners will receive their choice of one (1) of
the following Club Med "all-inclusive" vacations for
four (4): (i) Paradise Island, Bahamas; (ii) Crested Butte,
Colorado; or (iii) Cancun, Mexico. Prize includes standard
accommodations for four, two rooms double occupancy for 7
nights; coach airfare for four people on a designated airline
between a major commercial airport in the Territory near the
winner's home as designated by the Sponsor and the designated
domestic or international airport, near the selected Club Med
destination, as designated by the Sponsor; round-trip ground
transportation between selected Club Med and the destination
airport; and all meals at the selected Club Med property, per
person, per day. Prize does not include beverages, other than
those regularly served during meals, at the Club Med property.
Prize includes standard Club Med sports equipment and
instruction, but does not include any ski rental or SCUBA
equipment or instruction. Vacation is valid between July 12,
2001 and December 1, 2002 and is subject to availability and
blackout dates. All persons choosing to go to the Club Med in
Cancun, Mexico, must be at least 18 years old (ARV: $8,000).
Adventure

Automobile
and Adventure Vehicle Prizes:
Winner must take delivery of the Automobile/Adventure Vehicle
from a dealership near the winner's home designated by Sponsor
within the continental United States. Automobile/Adventure
Vehicle colors will be determined based on availability in
Sponsor's sole discretion. Winner is responsible for all taxes
and expenses, including but not limited to: sales tax, luxury
tax, delivery, processing and handling fees, registration, title
and license fees, insurance, and all other costs incurred in
claiming, registering or using the Automobile/Adventure Vehicle.
Winner is responsible for all costs associated with any
upgrade/option package. Each Automobile/Adventure Vehicle will
be delivered solely with the express limited warranties set
forth in the applicable Automobile/Adventure Vehicle's
applicable Owner's Guide, which warranties shall run for the
term set forth in said guide. SPONSOR RESERVES THE RIGHT WITH

Travel
Prizes: If a travel prize
is won by a minor, he/she must be accompanied on the trip by
his/her parent or legal guardian. Winner and guests must travel
together and possess all required travel documents, including
visas and valid passports. Prize winner is responsible for any
other expenses incurred on the trip including but not limited to
additional ground transportation, airport taxes or fees,
gratuities and any other incidental expenses. APPROXIMATE RETAIL
VALUE FOR TRAVEL PRIZES MAY VARY DEPENDING UPON POINT OF
DEPARTURE AND FARE FLUCTUATION. FOR TRAVEL PRIZES, THE
ROUND-TRIP AIR TRANSPORTATION ELEMENT FOR THE PRIZE BEGINS AND
ENDS AT THE DESTINATION (EXCEPT WHERE OTHERWISE SPECIFIED
HEREIN, MAJOR COMMERCIAL AIRPORT IN THE TERRITORY) NEAR THE
WINNER'S RESIDENCE. SPONSOR RESERVES THE RIGHT TO STRUCTURE
TRAVEL ROUTE IN ITS SOLE DISCRETION.

No interest will

choice, if a lesser-valued prize is selected, the difference in

5. GENERAL
CONDITIONS OF PARTICIPATION
The submission of
Game Stamps and/or other Game materials for verification is
solely the responsibility of the participant. Participant
assumes all risk of loss, theft, damage, destruction, delay and
misdirection of Game Stamps and other Game materials and is
advised to obtain insurance where appropriate. McDonald's
Corporation (the "Sponsor") will not be
responsible for incomplete, illegible, late, lost, or
postage-due submissions of Game Stamp(s) or other Game
materials, which may be judged void. Proof of mailing does not
constitute proof of delivery. Game Stamps and other Game
materials submitted become the property of Sponsor and will not
be returned. No cash alternative or substitution of any prize
will be provided, except as specified herein or in the case of
extraordinary circumstances at the sole discretion of the
Sponsor. Sponsor at its sole discretion reserves the right to
substitute a prize of equal or greater value if any prize cannot
be awarded as described due to unavailability. Prizes will only
be delivered to an address in a participating Territory, except
as otherwise specified in Rule 4 above. Upon delivery to a
designated address in the participating Territory, Sponsor will
be deemed to have awarded the prize to the winner with winner
assuming full title, ownership of and responsibility for the
prize. An officially verified winner may transfer his/her
completed collection prize section or Instant Win Stamp(s)
without consideration, to another eligible person prior to award
ONLY if authorized in writing by the Redemption Center,
at Sponsor's sole discretion. Requests for transfer must be in
writing and should be included in the Redemption
Envelope/materials with the potential winning Game Stamp(s).
By participating
in the Game, participant agrees to abide by and be bound by
these Official Rules and by the decisions of the Sponsor and the
Redemption Center, which are final and binding in all respects.
Prizes will be awarded only if a participant fully complies with
these Official Rules. Participant waives the right to assert as
a cost of winning any prize, any and all costs of verification
and redemption or travel to redeem said prize and any liability
and publicity that might arise from redeeming or seeking to
redeem said prize. Any and all applicable taxes on a prize are
the sole responsibility of the prize winner. If required by law,
Sponsor or its agents shall require payment from prize winner to
remit to the appropriate taxing authorities the amount of any
tax or taxes due.
Potential prize
winner will be required, as a condition of winning a prize, to
sign and return within a specified time, an affidavit of
eligibility/liability release, and where legal, a publicity
release, and any applicable forms required by tax authorities
and prize suppliers. Guest(s) of a travel prize winner will also
be required to execute a liability release and where legal, a
publicity release. Should a prize winner or guest make any false
statement in any document referenced above, the winner will be
required to promptly return to Sponsor, upon demand, his/her
prize or, at Sponsor's option, the cash equivalent. By
participating in the Game, winner releases and agrees to hold
harmless Sponsor and Hasbro, Inc., and their licensees,
franchisees, parents, affiliates, subsidiaries, local corporate
advertising cooperatives, advertising and promotion agencies,
and prize suppliers, and all of their respective directors,
officers, employees, representatives and agents, from and
against any and all liability for any loss, property damage or
damage to persons, including, without limitation, death, and
injury, due in whole or in part, directly or indirectly, from or
arising out of participation in this Game, or participation in
any Game related activity, or the receipt, use or misuse of a
prize. By submitting potential winning Game Stamps and
other Game materials, verified winners authorize McDonald's and
their promotional partners to use their name, address (city,
state and country) and/or their photograph, any taped appearance
or interview with them or any likeness of them, their voice
and/or any statements made by or attributed to them, in
perpetuity, in connection with the publicity, advertising or
promotional activities for the Game or any other like or similar
future promotion (where legally permissible), in any and all
media now known or hereafter developed (including, without
limitation, print, broadcast and Internet), and to the use of
statements made by or attributed to winner relating to
McDonald's, and any and all rights to said use, without further
compensation.
Subject to any
governmental approval which may be required, Sponsor reserves
the right, without prior notice and at any time, to terminate or
suspend the Game, in whole or in part, or modify the Game in any
way, should any factor (including but not limited to fraud or
security breach) interfere with the Game's proper conduct as
contemplated by these Official Rules, or if Sponsor believes
that the Game has been or will be compromised in any way.
Further, Sponsor reserves the right to void any Game Stamp
submitted for a prize, if Sponsor believes such Game Stamp was
obtained other than through regular channels of business as
contemplated by these Official Rules or that the Game Stamp has
been tampered with in any manner. Without limiting the
generality of the foregoing, if through printing, production or
other errors, or for any other reason, more official winning
Game Stamps than intended, as indicated in these Official Rules,
are printed, distributed or received for any prize, the winners,
or remaining winners, as the case may be, at Sponsor's sole
discretion, may be selected in a random drawing from among all
unfulfilled winning prize claims received for that prize. Only
the prizes described and quantity of prizes offered in these
Official Rules will be available to be won in this Game. It is
the participant's responsibility to ensure that he/she has
complied with the conditions contained in these Official Rules.
Unclaimed prizes shall not be awarded. Promotion void in whole
or in part where prohibited by law.
6.
ELIGIBILITY
The Game is
offered at participating McDonald's restaurants in the Territory
and it is open only to legal residents of the U.S., Guam, Saipan,
Bahamas, Curacao, Aruba, St. Maarten, St. Thomas, Suriname and
Trinidad. There is no age limit to play or to redeem McDonald's
Food prizes. In the event that Cash on the Spot prizes are won
by a minor, he/she must be accompanied by a parent or legal
guardian in order to redeem. High and Mid-Level prizes won by a
minor will be awarded only in the name of his/her parent or
legal guardian in trust for the minor and such parent or legal
guardian will be responsible for causing all applicable taxes to
be paid. Persons in any of the following categories are NOT
eligible to participate or win prizes in the Game: (a) persons
who on or after October 1, 2000, were or are employees or agents
of Sponsor, Hasbro, Inc., prize suppliers, or their respective
parents, subsidiaries, affiliated companies, franchisees, or
service agencies, or independent contractors of any of the above
organizations; (b) individuals engaged in the development,
production or distribution of materials for this Game; and (c)
persons who are immediate family (defined as mother, father,
sister, brother, daughter, son or spouse) of any person in any
of the preceding categories, regardless of where they live; or
who reside in the same household, whether related or not, as any
person in any of the preceding categories.
7.
VERIFICATION
All Game Stamps
and other Game materials are subject to verification at a
participating McDonald's or the Redemption Center, whichever is
applicable according to Rule 3 above. A McDONALD'S RESTAURANT
MANAGER'S SIGNATURE ON THE REDEMPTION ENVELOPE DOES NOT
MEAN THAT THE GAME STAMP(S) HAS BEEN VERIFIED AS A WINNING
STAMP(S). Game Stamps and other materials are null and void
and will be rejected if tampered with in any way (except for the
signed initials of the potential winner), if obtained where the
Game is prohibited or not obtained legitimately, if any part is
counterfeited or reproduced, or if they are from other games or
promotions (including past Monopoly games at McDonald's), and
may be rejected, in Sponsor's sole discretion, if any part is
illegible, incomplete, damaged, mutilated, or if they contain or
reflect printing, typographical, mechanical or other errors. All
decisions of Sponsor and the Redemption Center are final,
binding and conclusive in all matters. Only Game Stamps with
artwork featuring the words "©McDonald's Corp." and
"2001" and "Monopoly®" printed on the face
of the Game Stamp will be accepted for verification. Winning
Game Stamps contain special points of identification that have
been verified by an independent accounting firm.
IMPORTANT: ANY
PERSON ATTEMPTING TO FORGE GAME STAMPS OR OTHER GAME MATERIALS
OR TO DEFRAUD McDONALD'S IN ANY WAY IN CONNECTION WITH THIS GAME
WILL BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW.
8. GAME
SCHEDULE
The Game will
begin on or about July 11, 2001 and is scheduled to end on
August 9, 2001. Regardless of the scheduled end date, the Game
will officially end when all Game Pieces have been distributed,
subject to redemption deadlines for High and Mid-Level prize
claims outlined in Rule 3E. Therefore, some participating
McDonald's restaurants may complete distribution of their supply
of packaging containing Game Pieces before others, and as the
Game progresses, Game Pieces may be available at some McDonald's
restaurants, and not others. Game Pieces may be depleted on some
forms of packaging before others. Although a participating
McDonald's may have exhausted its supply of packaging containing
Game Pieces, it will continue to redeem McDonald's Food, Gift
Certificates and Cash on the Spot Instant Win Stamps, $20 Baltic
and Mediterranean Collection Stamps, and distribute Redemption
Envelopes for High and Mid-Level Collect to Win prizes and
Mid-Level Instant Win prizes in accordance with these Official
Rules, through the Redemption Deadlines outlined in Rule 3E
above.
9.
ARBITRATION
Except where
prohibited by law, as a condition of participating in this Game,
participant agrees that (1) any and all disputes and causes of
action arising out of or connected with this Game, or any prizes
awarded, shall be resolved individually, without resort to any
form of class action, and exclusively by final and binding
arbitration under the rules of the American Arbitration
Association and held at the AAA regional office nearest the
participant; (2) the Federal Arbitration Act shall govern the
interpretation, enforcement and all proceedings at such
arbitration; and (3) judgment upon such arbitration award may be
entered in any court having jurisdiction. Under no circumstances
will participant be permitted to obtain awards for, and
participant hereby waives all rights to claim, punitive,
incidental or consequential damages, or any other damages,
including attorneys' fees, other than participant's actual
out-of-pocket expenses (i.e., costs associated with entering
this Game), and participant further waives all rights to have
damages multiplied or increased.
10. CHOICE
OF LAW
All issues and
questions concerning the construction, validity, interpretation
and enforceability of these Official Rules, or the rights and
obligations of participant and Sponsor in connection with the
Game, shall be governed by, and construed in accordance with,
the substantive laws of the State of Illinois, USA without
regard to Illinois choice of law rules.
11. LIST OF
PRIZE WINNERS OR OFFICIAL RULES
For a list of
major prize winners (available after December 8, 2001) or a copy
of these Official Rules, mail, postage pre-paid, a hand-printed
self-addressed stamped envelope to: 2001 MONOPOLY Game at
McDonald's, Winner's List or Official Rules Request, P. O. Box
466001, Lawrenceville, GA 30042-6001. Only one request for
Official Rules or a Winner's List per outer envelope, mailed
separately. All requests must be received between July 11, 2001
and October 8, 2001. DO NOT SEND POTENTIAL WINNING GAME STAMPS
OR ANY OTHER GAME STAMPS, GAME MATERIALS, COMMENTS OR QUESTIONS
TO THIS ADDRESS.
