Winning Time Game Rules (as McDonalds has posted them)
The Winning Time™ Game at McDonald’s (the "Game") provides participants with the chance to win prizes instantly by peeling official winning "Game Pieces" (defined below). The Game is played as set forth below and is subject to these Official Rules. Each person who participates in the Game fully and unconditionally agrees to comply with and abide by these Official Rules and the decisions of McDonald’s Corporation ("Sponsor") and the Official Game Redemption Center (the "Redemption Center"), which shall be final and binding in all respects. The Game begins on or about March 25, 2003 in the United States, Aruba, Suriname and Trinidad (the "Territory"), is scheduled to end April 21, 2003 (See Rule 8 for Game Schedule details), and is subject to the redemption deadlines set forth in Rule 4(d) below.
  1. ELIGIBILITY
    The Game is open only to legal residents of the Territory. There is no age limit to play or to redeem McDonald’s food items that are prizes in the Game ("Food Prizes"). High-, Mid- and Low-Level prizes won by a minor will be awarded only in the name of his/her parent or legal guardian on behalf of the minor. Additional age restrictions apply with respect to the Winnebago® Motor Home Rental Vacation Package and the Carnival Cruise Vacation Package, both described in Rules 5 and 6 below. Persons in any of the following categories are NOT eligible to participate or win prizes in the Game: (a) persons who on or after May 1, 2002, were or are franchisees, directors, officers, employees or agents of Sponsor, prize suppliers, or their respective parent, subsidiary, or affiliated companies, franchisees, or service agencies, or independent contractors of any of the above organizations; (b) individuals engaged in the development, production or distribution of materials for the Game; and (c) persons who are immediate family members (defined as spouse or biological or step- mother, father, sister, brother, daughter, or son) of any person in any of the preceding categories, regardless of where they live, or who reside in the same household, whether related or not, as any person in any of the preceding categories. 
  2. HOW TO OBTAIN GAME PIECES
    There are two ways to obtain an Official Game Piece (each a "Game Piece") in the Game while supplies last:

    1. In Store. At participating McDonald’s Restaurants in the Territory, one Game Piece is attached to each of the following packaging items: Large and Super Size® Drink Cups (sizes may vary by market), Medium, Large and Super Size® Fry Boxes (sizes may vary by market), Big Mac® boxes, Quarter Pounder® with Cheese packaging and Hash Brown bags; or

    2. Mail In. Game Pieces may be obtained without a McDonald’s purchase by mailing, postage prepaid, a hand-printed self-addressed, stamped envelope ("SASE") to: McDonald’s Winning Time Game, Game Piece Request, P.O. Box 1240, Young America, Minnesota, 55594-1240. Vermont residents may omit return postage. DO NOT SEND POTENTIAL WINNING GAME PIECES OR ANY OTHER GAME PIECES, GAME MATERIALS, COMMENTS OR QUESTIONS TO THIS ADDRESS. Each participant may submit as many requests as he or she desires, but only one request (SASE) per outer envelope mailed separately will be fulfilled. Three (3) Game Pieces will be mailed in response to each mail in request received in accordance with the foregoing instructions, while supplies last. Mail in requests must be postmarked no later than April 21, 2003 and received no later than April 28, 2003. These dates are subject to extension pursuant to and in accordance with Rule 8 of these Official Rules in the event Game Pieces are still being distributed beyond such dates, but even if such dates are so extended, the redemption deadlines set forth in Rule 4(d) will continue to apply.
  3. HOW TO PLAY
    To play the Game, obtain a Game Piece as described above. To reveal the face of the Game Piece and determine if it is a potential winner, carefully peel off the Game Piece from the Winning Time food or drink packaging. In the case of Game Pieces not affixed to food or drink packaging, detach them from the backing. If a description of a prize identified in Rule 5 below is revealed, the participant is the potential winner of the prize indicated, subject to verification of the Game Piece (the "Winning Game Piece") and the participant’s compliance with these Official Rules (including, without limitation, compliance with the eligibility restrictions set forth above). To claim any prize, the participant must follow the redemption instructions in Rule 4 below. All prizes and their approximate retail values ("ARV") are detailed in Rule 5 below. The odds of winning each prize are set forth in Rule 14 below. If a Game Piece reveals any of the following phrases, it is NOT a Winning Game Piece: Sorry, can’t win every time; Sorry, perhaps another time; Maybe another time; Maybe some other time; This time’s not a winner; Sorry, it wasn’t your time; Sorry, this time you didn’t win; Sorry, possibly next time; or words of similar import.

    NOTE: Potential winners are not Official Winners of any prize until the Game Piece has been redeemed and verified in accordance with these Official Rules. If any potential winner is found to be ineligible, or if she/he has not complied with these Official Rules, such potential winner will be disqualified.

     

  4. HOW TO REDEEM

    1. To Redeem Food Prizes. McDonald’s Food Prizes may be redeemed at any participating McDonald’s Restaurant in the Territory. Winning Game Pieces for McDonald’s Food Prizes are subject to verification upon presentation and may be redeemed only during the hours the food product is served and only on a future visit, except where prohibited by law. Winning Game Pieces for McDonald’s Food Prizes are not valid in combination with any other offer or discount. Only one (1) McDonald’s Food Prize redemption per eligible person per visit. All visits to the same restaurant within a two-hour period are deemed to constitute a single visit for purposes of the Game. A Winning Game Piece for a McDonald’s Food Prize must be presented for redemption before the food order is placed. Participating McDonald’s Restaurants reserve the right to substitute a food product of equivalent or greater retail value for the Food Prizes specified.

    2. To Redeem High- And Mid-Level Prizes. If the Game Piece directs the participant to call a Toll Free number, do so immediately for redemption instructions, and follow those instructions. After calling the Toll Free number on the Game Piece and following the instructions given during such call, an Official "WINNING TIME" Redemption Envelope will be sent to the POTENTIAL WINNER. Use the Redemption Envelope to mail the HIGH- OR MID-LEVEL POTENTIAL WINNING GAME PIECE to the Redemption Center for Verification. The Participant will be directed to send the submission using United States Postal Service Express Mail with a receipt of mailing (though proof of mailing does not constitute proof of delivery). DO NOT SHOW OR GIVE ANY POTENTIAL WINNING GAME PIECE FOR PRIZES OTHER THAN McDONALD’S FOOD PRIZES TO ANY McDONALD’S EMPLOYEE. McDonald’s employees or managers CAN NOT verify or redeem Winning Game Pieces for prizes other than McDonald’s Food Prizes. Consult Rules 5 or 14 below to confirm prizes classified as High- or Mid-Level.

    3. To Redeem Low-Level Prizes. To redeem a Low-Level Prize, the participant may either call the Toll Free number printed on the potential Winning Game Piece and carefully follow the instructions, OR mail the potential Winning Game Piece for verification to:

      Please note that Federal Express or other overnight shipping companies are unable to deliver to a Post Office box. As a result, the participant must send the submission using the United States Postal Service. It is strongly recommended that the participant send the submission using Registered, Certified or Express Mail with a receipt of mailing (though proof of mailing does not constitute proof of delivery). DO NOT SHOW OR GIVE ANY POTENTIAL WINNING GAME PIECE FOR PRIZES OTHER THAN McDONALD’S FOOD PRIZES TO ANY McDONALD’S EMPLOYEE. McDonald’s employees and managers CAN NOT verify or redeem Winning Game Pieces for prizes other than McDonald’s Food Prizes. Consult Rule 5 or 14 below to confirm prizes classified as Low-Level.

    4. Redemption Deadlines. All Winning Game Pieces for Food Prizes must be redeemed at a participating McDonald’s Restaurant ON OR BEFORE (i) MAY 6, 2003 or (ii) The date which is 15 DAYS after the Game officially ends, whichever is later. See Rule 8 below for Game Schedule details.

    FOR HIGH- AND MID-LEVEL PRIZE CLAIMS, all calls to the TOLL FREE number MUST BE RECEIVED ON OR BEFORE JUNE 10, 2003 and all necessary Game materials for such prize claims must be received for redemption and verification by the Redemption Center ON OR BEFORE JUNE 20, 2003. Please note that these dates are not subject to extension under Rule 8.

    All claims for LOW-LEVEL PRIZES must be postmarked ON OR BEFORE JUNE 10, 2003 and received for redemption and verification by the Redemption Center ON OR BEFORE JUNE 20, 2003. Please note that these dates are not subject to extension under Rule 8.

    All Game materials received after the above deadlines are VOID and will be ineligible for prizes. Game materials submitted to the Redemption Center will be verified within eight (8) weeks after the Game materials are received, or as soon thereafter as is reasonably practical. Verified High-, Mid-, and Low-Level prize winners will be notified by mail.

    NOTE: A participant may win more than one prize, but a participant is not a winner of any prize until the Game Piece and other Game materials, and the participant’s compliance with these Official Rules (including, without limitation, the eligibility restrictions set forth above), have been verified at either the Redemption Center (for Low-, Mid- and High-Level Prizes) or at a participating McDonald’s Restaurant (for Food Prizes).

    2. High-Level Prizes

      Grand Prizes: $100,000 Cash in U.S. Currency:
      Four (4) winners will receive a check in the amount of $100,000.

      2003 Corvette® : Twenty (20) winners will receive a 2003 model year (or later) Chevrolet Corvette. Winners must take delivery of the vehicle from an authorized dealership near the winner’s home, as designated by Sponsor. Vehicle colors will be determined based on availability in Sponsor’s sole discretion. Winner is responsible for all taxes and expenses, including but not limited to: sales tax, delivery, processing and handling fees, registration, title and license fees, insurance, and all other costs incurred in claiming, registering or using the vehicle. Winner is responsible for all costs associated with any customized upgrade/option package. Each vehicle will be delivered solely with the express limited warranties set forth in the vehicle’s Owner’s Guide, which warranties shall run for the term set forth in said Guide. Sponsor reserves the right with respect to vehicle prize to extend the delivery date by up to 6 months from the date of notification to the winner. Sponsor at its sole option may substitute a model year 2003 or 2004 vehicle of the same or like model and style (or, if Sponsor so elects in its sole discretion, a cash equivalent) in the event of scarcity due to limited production or unavailability for any other reason. Once a winner has been notified that the vehicle he or she has been awarded is at a dealership, such winner will have 30 days within which to pick up the vehicle. Vehicles will be released only upon proof of valid driver’s license and satisfactory proof of insurance. Winners who are minors in their state of residency will be required to provide their parent or legal guardian’s written consent to receive delivery of vehicle prize that was awarded in the parent or legal guardian’s name. Corvette is a registered trademark of General Motors Corporation. ARV: $58,000 each.

      One Million United® Mileage Plus® Miles: Ten (10) winners will receive One Million United Mileage Plus miles good for travel on United Airlines or its 14 participating airline partners to over 700 destinations worldwide. Winners must be enrolled in Mileage Plus or, if not already a member, will be required to enroll in order to receive prize. Miles accrued and awards issued are subject to the rules of the United Mileage Plus program. Taxes and fees related to award travel are the responsibility of the winner. United may change Mileage Plus Program rules, regulations, travel awards and special offers or terminate the Mileage Plus program at any time and without notice. Mileage Plus participation may not be permitted in some countries. Other terms and conditions apply. United and Mileage Plus are registered trademarks of United Air Lines, Inc. ARV: $23,000 each.

      $10,000 Cash in U.S. Currency: Twenty (20) winners will receive a check in the amount of $10,000.

    3. Mid-Level Prizes

      Winnebago® Motor Home Rental Vacation Package: Fifty (50) winners will receive a Vacation Package that includes: a $2,000 Recreational Vehicle ("RV") Certificate redeemable at one of eight authorized Moturis AAA RV Rental offices in the U.S. to be used toward the payment for a Winnebago motor home rental, rental of supplies, and any other services offered by the rental operator; a $250 Camping Certificate to be used at any of 500 Kampgrounds of America ("KOA") locations; and $3,500 to be used however the winner chooses (e.g., food, RV rental gas and/or ground or air transportation to/from RV Rental office, all of which are solely the responsibility of the winner). The RV Certificate and Camping Certificate are not redeemable for cash and may be used only for the rental of a Winnebago Industries motor home, other RV/camping services available at AAA Moturis RV Rental Offices, and camping services at KOA Kampgrounds. The RV and Camping certificates will expire one (1) year from date of issuance. Certificates are non-transferable and may not be sold. Advance reservation with rental operator is required. Renter must be 21 years or older and possess a valid and identifiable driver’s license. Winner must comply with all conventional terms and conditions as stipulated by the rental operator in its standard rental agreement. Winnebago is a registered trademark of Winnebago Industries.       Trip for 4 to the Dover 400® NASCAR® Weekend with the opportunity to meet Tony Stewart: Five (5) winners will receive a trip for four (4) consisting of roundtrip, coach class air transportation to/from a major airport nearest winner's residence to Wilmington, DE Airport; 4 days/3 nights standard two (2) rooms double occupancy hotel accommodations in a hotel selected by Sponsor in its discretion; four (4) tickets to the 2003 Dover 400 Weekend races which could have Tony Stewart participating; the opportunity to meet Tony Stewart; ground transportation for four (4) to/from Wilmington airport to hotel and to/from hotel to Dover International Speedway; and $500 spending money to be used however the winner chooses (e.g., food or rental car expenses, which are solely the responsibility of the winner). Sponsor shall not be liable if Tony Stewart’s appearance is cancelled, postponed, delayed, diverted, or abbreviated due to any cause not reasonably within Sponsor’s control, and in the event of any such occurrence, the remaining elements of the trip shall constitute full satisfaction of Sponsor’s prize obligations to the applicable prize winner and such winner will not be entitled to any substitute prize(s) or monetary entitlement. Winner and guests must be able to travel on the same itinerary departing on September 19, 2003 and returning September 22, 2003 or prize will be forfeited in its entirety. The National Association for Stock Car Auto Racing, Inc. name ("NASCAR") and logo are the property and registered trademarks of NASCAR, Inc. "Dover International Raceway" and "The Dover 400" are the property and registered trademarks of Dover Motorsports Inc. ARV: $5,950 each.

      Trip for 2 to the 2004 NCAA® Final Four® : Five (5) winners will receive a trip for two (2) consisting of roundtrip, coach class air transportation to/from a major airport nearest winner's residence to San Antonio, Texas; 5 days/4 nights standard double occupancy hotel accommodations in a hotel selected by Sponsor in its discretion; two (2) Club Level tickets to Final Four on April 3 and April 5, 2004; and $1,000 to be used however the winner chooses (e.g., food or rental car expenses in San Antonio, TX, which are solely the responsibility of the winner). Winner and guest must be able to travel on the same itinerary departing on April 2, 2004 and returning April 6, 2004 or prize will be forfeited in its entirety. The National Collegiate Athletic Association name ("NCAA"), "The Final Four", "Final Four", "NCAA Basketball" and applicable logos are the property and registered trademarks of NCAA, Inc. The Coca-Cola Company is an Official NCAA Corporation Champion. ARV: $5,200 each.

      Carnival® Cruise Vacation Package: Twenty-five (25) winners will receive a four (4) day "Fun Ship" cruise for two (2) aboard Carnival Cruise Lines. Prize includes roundtrip coach class air transportation for two (2) to/from a major airport nearest winner’s residence to major airport closest to port of departure, ground transportation to/from airport to port boarding location, 4 days/3 nights Stateroom accommodations (category 4A interior based on double occupancy) aboard winner’s choice (based on availability) of one of the following ships: Fascination (departing Miami, FL), Fantasy (departing Pt. Canaveral, FL), Celebration (departing Galveston, TX), Imagination (departing Miami, FL), Sensation (departing Tampa, FL), Holiday (departing New Orleans, LA) or the Ecstasy (departing Los Angeles, CA); and $1,000 spending money. Prize consists of only those items specifically provided for herein as part of the prize.       Trip for 2 to an NBA® Game with the opportunity to meet Kobe Bryant: Five (5) winners will receive a trip for two (2) consisting of roundtrip, coach class air transportation to/from major airport nearest winner's residence to a destination to be determined by Sponsor; 3 days/2 nights standard double occupancy hotel accommodations in a hotel selected by Sponsor in its discretion; two (2) tickets to an NBA basketball game with Kobe Bryant participating, specific game location and time to be determined by Sponsor; the opportunity to meet Kobe Bryant; ground transportation for two (2) to/from game; and $800 spending money to be used however the winner chooses (e.g., food expenses in game city which are solely the responsibility of the winner). Sponsor shall not be liable if Kobe Bryant’s appearance is cancelled, postponed, delayed, diverted, or abbreviated due to any cause not reasonably within Sponsor’s control, and in the event of any such occurrence, the remaining elements of the trip shall constitute full satisfaction of Sponsor’s prize obligations to the applicable prize winner and such winner will not be entitled to any substitute prize(s) or monetary entitlement. Winner and guest must be able to travel on same itinerary on dates selected by Sponsor in November or December of 2003 or prize will be forfeited in its entirety. The National Basketball Association ("NBA") name and logo and the names and logos of the NBA teams are the property of NBA Properties, Inc. and the member teams of the NBA. ARV: $3,900 each.

      Trip for 4 for Court Time with Venus and Serena Williams: Five (5) winners will receive roundtrip coach class airfare for four (4) to/from a major airport nearest winner’s home to a major airport nearest West Palm Beach, Florida, airport transfers while in FL, 2 nights/3 days hotel accommodations (two rooms, double occupancy) in a hotel selected by Sponsor in its discretion, ground transportation to/from hotel; up to three (3) hours time with Venus and Serena Williams, which could include lunch, photo and autograph opportunities on a professional tennis court. Sponsor shall not be liable if Venus and/or Serena Williams’ appearance is cancelled, postponed, delayed, diverted, or abbreviated due to any cause not reasonably within Sponsor’s control, and in the event of any such occurrence, the remaining elements of the trip shall constitute full satisfaction of Sponsor’s prize obligations to the applicable prize winner and such winner will not be entitled to any substitute prize(s) or monetary entitlement. Winners and guests must be able to travel on dates designated by Sponsor or prize will be forfeited in its entirety. ARV: $3,400 each.

      One Year of Biweekly Maid Service from Merry Maids® : Seventy-five (75) winners will receive a Merry Maids voucher good toward maid service every other week for up to one year, with a total cleaning value not to exceed $2,200 (one year biweekly average based on 3 bedroom, 2 bathroom, 2,000 sq. ft. home). Maid service will be provided only in residences and cannot be applied to commercial properties. In the event Merry Maids service is not available in the prize winner’s local area, then in lieu of the cleaning voucher, Merry Maids will issue a separate voucher of equal value valid for services from its partner companies. Winner can choose from ServiceMaster Clean, Terminix, TruGreen-ChemLawn, Furniture Medic, American Home Shield, AmeriSpec and/or Rescue Rooter. If none of the above-mentioned services is available in the winner’s local area, the cash equivalent will be distributed to the winner. Cash or other vouchers will not be offered to those who live within a Merry Maids service area. Merry Maids is a trademark of ServiceMaster or its affiliates. ARV: $2,200 each.

      One Year America Online® Membership and a Hewlett-Packard® Computer System: One Hundred (100) winners will receive an America Online membership with membership fees waived for twelve months. If the winner is not currently registered as an AOL member, such winner must register for AOL Service by securing an account with a credit card or checking account. Winners are responsible for any premium surcharges, telephone bill charges and communications surcharges incurred while using the AOL service. Winners will also receive a Hewlett-Packard Desktop PC, which includes: Intel Pentium 4 Processor, 17" multimedia display monitor, DeskJet Printer, compatible software package, keyboard and mouse. If winner resides in Aruba, Suriname or Trinidad, then in lieu of the free AOL service described above, such winner will receive a cash equivalent of $287. In addition, Sponsor reserves the right to offer a cash equivalent of $1,650 for the computer system if compatible components are not available in winner’s local area.       $1,000 Cash in U.S. Currency: Five Hundred (500) winners will receive a check in the amount of $1,000.

      PlayStation®2 Computer Entertainment System with five PlayStation®2 Videogames: Two Hundred Fifty (250) winners will receive one (1) PlayStation 2 System and five (5) PlayStation 2 Videogames. Videogame titles will be rated E for EVERYONE or T for TEEN and selected by Sponsor in its discretion. If winner resides in Aruba, Suriname or Trinidad, then in lieu of the PlayStation2 System and game package described above, such winner will receive cash equivalent of $450. "PlayStation" and the "PS" Family logo are registered trademarks of Sony Computer Entertainment America Inc. ARV: $450 each.

      Motorola sm Wireless Phone and $100 Worth of Cingular® KIC sm Airtime: Five Hundred (500) winners will receive a Motorola 331 wireless phone and a $100 KIC airtime card. Winners must activate KIC service in order to use airtime. KIC service is subject to availability. Winners in non-Cingular licensed markets will receive cash equivalent of $250 in lieu of the wireless phone and KIC airtime card. Cingular Wireless is a registered trademark of Cingular Wireless LLC.     4. Low Level Prizes

      $100 Cash in U.S. Currency: Five Thousand (5,000) winners will receive a check in the amount of $100.

      $50 Cash in U.S. Currency: Thirteen Thousand Five Hundred (13,500) winners will receive a check in the amount of $50.

       

  6. PRIZE RESTRICTIONS

    1. General: ANY HIGH-, MID- OR LOW-LEVEL PRIZE WON BY A MINOR WILL BE AWARDED IN THE NAME OF SUCH MINOR’S PARENT OR LEGAL GUARDIAN ON BEHALF OF THE MINOR. Prizes pictured in game materials, point of sale, television, print advertising and promotional packaging are for illustration purposes only. Actual prize(s) may vary from the prize(s) pictured. All details and other restrictions of prizes will be provided to the applicable prize winner upon award of the prize. No interest will be paid on any cash prizes. Prizes will be awarded only if a participant fully complies with these Official Rules. No cash alternative or substitution of any prize will be provided (other than as may be provided above), except Sponsor in its sole discretion reserves the right to substitute a prize of equal or greater value if any prize cannot be awarded as described due to unavailability for any reason. Prizes will be delivered only to an address in the Territory. In the event Sponsor agrees, in its sole discretion, to deliver a prize to an address outside the Territory, the winner of such prize shall be solely responsible for paying all shipping and other costs associated with such delivery. All taxes (including, without limitation, federal, state, and local taxes) on or connected with any prize, and the reporting consequences thereof, are the sole and exclusive responsibility of respective winners. If required by law, Sponsor reserves the right to withhold and remit to the appropriate taxing authorities the amount of any tax or taxes due.

    2. Prize Transfer: An officially verified winner of a Low-, Mid- or High-Level prize may transfer his/her Winning Game Piece to another eligible person prior to award ONLY if authorized in writing by the Redemption Center, which authorization may be granted or withheld in Sponsor’s sole discretion. Requests for transfer must be in writing and must be included in the redemption envelope with the potential Winning Game Piece.

    3. Travel Prizes: If a travel prize is won by a minor, he/she must be accompanied on the trip by his/her parent or legal guardian. With respect to the Carnival Cruise, a minor is considered a person under the age of 21 and must be accompanied by a parent, relative or guardian 25 years or older. With respect to the Winnebago Vacation prize, the renter must be 21 years or older. Winner and guests must travel together and possess all required travel documents, including visas and valid passports, if and as applicable. Prize winners are responsible for all expenses incurred on the trip that are not specifically provided for herein, including but not limited to additional ground transportation, airport taxes or fees, gratuities and any other incidental expenses. If air travel is not required due to winner’s residence being in close proximity (100 miles or less) to travel prize destination, the air travel portion of prize will be forfeited. ARV for travel prizes may vary depending upon point of departure and fare fluctuation. For travel prizes, the round trip air transportation element for the prize begins and ends at the point of departure (unless otherwise specified herein). Sponsor reserves the right to structure travel route in its sole discretion.
  7. VERIFICATION
    All Game materials are subject to verification at the Redemption Center or at a participating McDonald’s Restaurant, whichever is applicable according to Rule 4 above. Game material submitted to the Redemption Center will be verified within eight (8) weeks after the Game materials are received, or as soon thereafter as is reasonably practical. Game materials are null and void and will be rejected if not obtained through authorized, legitimate channels, if any part is counterfeited or if they are from other games or promotions, and a Game Piece may be rejected if any part is illegible, mutilated, or tampered with in any way or if it contains or reflects printing, typographical, mechanical or other errors. Each participant acknowledges and agrees that the decisions of Sponsor and the Redemption Center shall be final, binding and conclusive in all matters relating to the Game. Only Game Pieces with artwork featuring the words "Winning Time" printed on the face of the Game Piece will be accepted for verification. Winning Game Pieces contain special points of identification that have been verified by an independent security firm.

    IMPORTANT: ANY PERSON ATTEMPTING TO FORGE GAME MATERIALS OR DEFRAUD McDONALD’S IN ANY WAY IN CONNECTION WITH THIS GAME WILL BE PROSECUTED TO THE FULLEST EXTENT PERMITTED UNDER THE LAW.

     

  8. GAME SCHEDULE
    The Game will begin on or about March 25, 2003 and is scheduled to end on or about April 21, 2003, but will continue until all Game Pieces have been distributed, subject always to the redemption deadlines outlined in Rule 4 of these Official Rules. As a result, as the Game progresses, some participating McDonald’s Restaurants may complete distribution of their supply of Game Pieces before others. Similarly, Game Pieces may be depleted on some forms of packaging before others. Although a participating McDonald’s Restaurant may have exhausted its supply of packaging containing Game Pieces, it will continue to honor Winning Time Game Pieces for McDonald’s Food Prizes that are redeemed in accordance with these Official Rules.

     

  9. MISCELLANEOUS

    1. Language Discrepancy. In the event there is a discrepancy or inconsistency between the English language version and the Spanish language version of these Official Rules or of any Game materials, the English version shall prevail and govern.

    2. General Rules Governing Participants and Winners. High-, Mid- and, if and as requested, Low-Level Prize winners will be required, as a condition of winning and redeeming a prize, to sign an affidavit of eligibility/liability release, and where legal, a publicity release, and to sign any applicable forms required by tax authorities and prize suppliers within a period of time dictated by Sponsor. Failure to do so will result in disqualification and forfeiture of the stated prize. Travel companions for any travel related prizes will be required to sign a liability release prior to ticketing. Should a prize winner or guest make any false statement in any document referenced above, the winner will be required to promptly return his/her prize or, at Sponsor’s option, the cash equivalent of the prize based on the ARV published in Rule 5, to Sponsor upon demand.

      The submission of Game materials is solely the responsibility of each participant. Participants assume all risk of loss, damage, destruction, delay and misdirection of Game materials and are advised to obtain insurance where appropriate. Sponsor will not be responsible for incomplete, illegible, misdirected, late, lost, or postage-due submissions of Game materials, which may be judged void. Proof of mailing does not constitute proof of delivery. Game materials submitted become the property of Sponsor and will not be returned. Once verified, an eligible winner will receive the prize indicated on his or her Winning Game Piece within 8-12 weeks of the Redemption Center’s receipt of all prize documentation.

      By participating and redeeming a prize, winner releases and agrees to hold harmless the Sponsor, The Marketing Store Worldwide, L.P., their successors, assigns, franchisees, parents, affiliates, subsidiaries, local corporate advertising cooperatives, advertising and promotion agencies, and all of their respective directors, officers, employees, representatives, agents, the NBA and its member teams, NBA Properties, NBA Media Ventures LLC (collectively, the "Promotion Entities") and prize suppliers from and against any and all costs, injuries, losses or damages of any kind, including, without limitation, death and injury, due in whole or in part, directly or indirectly, to participation in the Game, or arising out of participation in any Game related activity, or the receipt, use or misuse of any prize. Participant waives the right to assert as a cost of winning any prize, any and all costs of verification and redemption or travel to redeem said prize and any liability and publicity which might arise from redeeming or seeking to redeem said prize. By submitting potential winning Game materials, verified winners agree to the use of their name, voice, and likeness, along with their address (city and state) and any statements made by or attributed to such winner in any and all media, now known or hereafter devised, in perpetuity and throughout the universe for advertising and promotional purposes in connection with the Game and other promotions without further compensation, and release the Promotion Entities from any liability with respect thereto. If Sponsor so elects, potential High-, Mid- and Low-Level Prize winners will be required to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Game will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Game, the Promotion Entities or any supplier of prizes for the Game, as determined by Sponsor in its sole discretion.

    3. Disqualification/Force Majeure. It is the participant’s responsibility to ensure that he/she has complied with the conditions contained in these Official Rules. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Game; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Game, or to annoy, abuse, threaten or harass any other person. Subject to any governmental approval which may be required, Sponsor reserves the right, without prior notice and at any time, to terminate the Game, in whole or in part, or modify or suspend the Game in any way, if it determines, in its sole discretion, that the Game is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions have destroyed or severely undermined the integrity and/or feasibility of the Game. Without limiting the generality of the foregoing, if by reason of printing or other error or for any other reason, more Winning Game Pieces are printed, distributed or received than the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Only the type and quantity of prizes described in these Official Rules will be awarded. Other than and except with respect to each of the four (4) $100,000 Cash Grand Prizes, which will be awarded through a second chance drawing pursuant to Rule 10 below in the event they are unclaimed in accordance with these Official Rules, unclaimed prizes will not be awarded. In the event Sponsor is prevented from continuing with the Game as contemplated herein by any event beyond its control, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a "Force Majeure" event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Game.

    4. Disclaimer of Warranties. The Promotion Entities make no warranties, and hereby disclaim any and all warranties, express or implied, concerning any Low-, Mid- or High-Level prize furnished by third parties in connection with the Game. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND/OR NON-INFRINGEMENT.

    5. Invalidity/Headings. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference, and shall not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision hereof.

     

  10. SECOND CHANCE DRAWING
    In the event one or more of the four (4) $100,000 Cash Grand Prizes is not claimed by the redemption deadlines and otherwise in accordance with these Official Rules (each an "Unclaimed Grand Prize"), each such Unclaimed Grand Prize, if any, will be awarded through a second chance random drawing ("Second Chance Drawing") held on or about July 1, 2003 by an independent judging organization using randomized methods within its sole discretion. To enter the Second Chance Drawing: mail a 3x5 index card with participant’s full name, address, city, state, zip code, daytime and evening phone numbers, including area codes legibly hand-printed in blue ink thereon to:

    Limit one (1) entry into the Second Chance Drawing per person per day. If multiple entries are received from the same person within any given day, only the first entry will be considered and all subsequent entries may be disqualified. No mechanically reproduced, illegible, incomplete, software generated or other automatic multiple entries will be accepted. Entries for the Second Chance Drawing may be submitted at any time starting when the Game begins on March 25, 2003, but must be received no later than June 20, 2003. The winner(s) of the Unclaimed Grand Prize(s) will be randomly selected from all eligible entries received through such date. The odds of winning a prize in the Second Chance Drawing depend on the number of Unclaimed Grand Prizes, if any, and the number of eligible entries received. If there are no Unclaimed Grand Prizes, there will be no Second Chance Drawing

     

  11. GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the participant or Sponsor in connection with the Game shall be governed by and construed in accordance with the internal laws of the State of Illinois without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.

     

  12. ARBITRATION DISCLOSURE: By participating in this Game, all participants agree that any and all disputes they may have with, or claims they may have against, Sponsor relating to, arising out of or connected in any way with (i) the Game, and/or (ii) the awarding or redemption of prizes, will be resolved individually, without resort to any form of class or representative action, and exclusively by final and binding arbitration pursuant to the rules established by the American Arbitration Association ("AAA") as stated in the Arbitration Provision below. Any participant who has any questions about the American Arbitration Association, or wishes to obtain a copy of the AAA’s rules and forms, may call (800) 778-7879 or visit the AAA’s website at www.adr.org. Participants acknowledge and agree that neither they nor Sponsor will have the right to litigate claims in court, to have a jury trial, or to engage in pre-arbitration discovery except as provided for in the AAA rules. Other rights and remedies that participants would otherwise have if they went to court also may not be available in arbitration. 

     

  13. ARBITRATION PROVISION: By participating in this Game, each participant agrees that: (1) Any claim, dispute, or controversy (whether in contract, tort, otherwise) arising out of, relating to, or connected in any way with the Game or the awarding or redemption of prizes will be resolved exclusively by final and binding arbitration conducted pursuant to the AAA’s Procedures for Consumer-Related Disputes in conjunction with the AAA’s Commercial Arbitration Rules (if and as applicable, depending on the amount in controversy); (2) This arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act ("FAA"), 9 U.S.C. §§ 1-16; (3) The arbitration shall be held at the AAA regional office nearest the participant; (4) The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable participant may have entered into in connection with the Game; (5) The arbitrator shall apply Illinois law consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (6) There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only the participant’s and/or Sponsor’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (7) The arbitrator shall not have the power to award punitive damages against the participant or Sponsor; (8) In the event that the administrative fees and deposits the participant is required to pay under the AAA rules exceed $125, and the participant is unable to pay the additional fees and deposits, Sponsor agrees to forward them on the participant’s behalf, subject to ultimate allocation by the arbitrator. In addition, if the participant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the participant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (9) If any part of this Arbitration Provision is deemed to be invalid or otherwise unenforceable or illegal, the balance of this Arbitration Provision shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein.

     

  14. LIST OF PRIZE WINNERS OR OFFICIAL RULES
    For a list of major prize winners or a copy of these Official Rules, mail, postage pre-paid, a hand-printed self-addressed stamped envelope to:

    Only one request for Official Rules or a winners list per outer envelope, mailed separately will be fulfilled. DO NOT SEND POTENTIAL WINNING GAME PIECES OR ANY OTHER GAME PIECES, GAME MATERIALS, COMMENTS OR QUESTIONS TO THIS ADDRESS. All requests must be received between March 25, 2003 and June 20, 2003. A list of prize winners will be available no sooner than August 10, 2003. The winners list will be mailed when the Game is officially over and prizes are verified and awarded
